Piaggio wins patent case vs Peugeot in CA
Back in 2021, an Italian Court ruled in favor of Piaggio in a lawsuit vs Peugeot. The case was about a European tech patent of the Piaggio MP3 three-wheel scooter. The case filed alleged Peugeot used their proprietary technology on their Metropolis three-wheeler model.
Peugeot Motocycles, owned by the Indian conglomerate, Mahindra, was ordered by courts to pay damages calculated to EUR 1.5-million or roughly PHP 95.6-million (in today’s exchange rate). Additionally, Peugeot was ordered to pay the penalties for infringement and related legal expenses.
Peugeot has escalated the case to the Corte di Cassazione – Italy’s Court of Appeals, but has lost the case, again.
“[This] ruling of the Corte di Cassazione and the consequent definitive finding that a patent owned by Piaggio & C. S.p.A. had been infringed highlights the importance and the value of the technological results achieved by the Piaggio Group with its sizeable R&D investments, which have put the Piaggio Group at the cutting edge of three-wheel vehicle technology and won the Piaggio MP3 a leadership position on the market,” said Piaggio in a statement released shortly after the court decision.
The earlier court order prohibited Peugeot Motocycles company on Italian territory from importing, exporting, marketing and advertising (offline and online) the Peugeot Metropolis, with a fine of EUR 6,000 (roughly PHP 382,700) for every vehicle sold after a term of 30 days from the announcement of the sentence. Peugeot Motorcycles must also withdraw all counterfeit vehicles from sale in Italy within 90 days, on penalty of payment of an additional fine of EUR 10,000 (roughly PHP 638,000) for every day that they delay in executing the order.
